I don't know the specificities of the case, but in general it's not as clear cut as it might look... Kids have the right to know and have a relationship with their parents, and that correlates with the rights of the parents. I know it sounds awful and it probably is, but I wouldn't be too quick to dismiss the claim of the rapist.

Wouldn't like to be on the judge's shoes though...

Question; is it specifically legal for a rapist to sue for custody OR has the situation never come up and thus the need to close a "loop hole" has never needed to happen?
Like I understand if the law is something along the lines of the biological parents have a right to sue for custody. BUT if the law is that a rapist has the right to sue for custody... well that shit is just beyond words.

Loophole. And, the CHILD has a right to ask to meet his/her parent(s) - later in life. The rapist should have no right to be a figure in the kid's upbringing. Being indoctrinated by a rapist ought to be worse than being indoctrinated into religion.

Possible scenario:
Boy meets girl, they fall in love, their passion overwhelms them.
Romeo and Juliet kinda thing.
Without access to sex education (coming from a religious state that forbids such knowledge) she is with child.
Both being underage he is convicted of statutory rape even though it was consensual.

The judge understands that the law is unfair because the two are in love so he is not imprisoned but put on probation.
Romeo would have had the same fate if the play was set in the USA and not Verona.

He loves her so much that he pays child support and wants involvement as a parent of the love-child.

The probation order says he can't see his child and he wants it overturned.

True love, romance, all the makings of a novel, play, musical and movie.
