A man rapes a woman, they find him months later, she is pregnant or has given birth.
The rapist can go: If you press charges, I will sue for custody.

In many places rape and other types of sexual abuse requires the victim to press charge before the state can act.

Unless there's a specific law preventing rapists pushing for access/custody this isn't as clear cut as people seem to think.

As much as everyone seems to see Western Governance as a dictatorship it isn't. The Government is bound by the law and courts just the same as the rest of us. They cannot just turn around and ignore the law. They can change the law but this is a far more complicated process.

I haven't watched the video but it is entirely possible that their are laws designed to make a path way for biological parents to be involved in their children's lives, even ex-cons. If so then technically that applies to rapists and their children too. Even if the law wasn't designed for that it may have that effect.
