This story has been making the rounds for over a year. It's a civil suit. He's not being "tried" as that implies a risk of criminal sanctions.

I don't know the status or the specifics, but it sounds like the kind of thing that gets thrown out of court rather easily.

Edit: that wiki says the suit was not thrown out over jurisdictional issues, which is what I expected. Either that or a standing issue. Maybe the claim has legs.
