If you have a disclaimer with a check box thing you'll be protected.
It's not your fault someone lied not to mention they can't prove someone younger than 18 was on that computer, it could have been a parent.

Don't do the ID thing, it's stupid and a waste of time. AF are stuck up their asses, we don't need to do something simply because they do it. ESPECIALLY when they do it wrong.

If you have any links to articles supporting the stance that that will be full legal protection then that would be great. An answer of "this is the case and I just know it" is not very reassuring.

*points at any r18 website anywhere on the internet*

The issue is one of "are you over 18". Nothing to do with porn.
It's a contract law issue and thus terms and conditions with clear outlines and a little tick box thing saying "if you agree" or "you agree you are over 18" is sufficient.

Considering I studied this shit for 2 years, "this is the case and I just know it" is very reassuring.

If you so desire; this is my legal advice to you in this given situation.
There, now I'm liable for giving wrong advice (though it's not wrong) because I haven't included a disclaimer removing my liability.

Well, yeah, but legal advice is really easy to give when you aren't liable for the consequences.

Yes

Oh yea, because I don't care if TTA get's sued or not... Dodgy

Sarcasm aside, it's a fair question.

Should we be covered for likely eventualities?

Or should we be covered for all eventualities?

And again I say, if we are covered now then adding a rule saying 18+ only just makes us more covered not less.

It's like having a naked woman and being afraid to put clothes on her because she'd still be naked underneath...

Swing with me a while, we can listen to the birds call, we can keep each other warm.
Swing with me forever, we can count up every flower, we can weather every storm.

Send in your ID to prove your 18+?? what??

The only thing you need to cover your ass is a disclaimer and a little box to check "yes I am 18+".
Just go to some porn site and copy and paste theirs.

Exactly.

This is stupid.

The little checkbox thing won't do anything to actually keep out the youngsters. You know, the actual thing we would like to accomplish. The legal issue would be covered, but that's not the only consideration. Having to show ID wouldn't be a perfect fix, but it would be a deterrent that may actually deter them. Unless they already have a fake, I doubt that our sexy talk would be the thing that makes them go get one.

This is a fair point actually.
I was arguing from a legal point though. Legally we would be covered.
I'm not delusional to think a little check box would keep every under 18 person out.

A terms and conditions/check box would cover all eventualities.
The only 2 possible outcomes are someone over 18 gains access or someone under 18 gains access.
The terms and conditions/check box covers your (tta) ass against the later.

... but the relevant age is not 18 in all jurisdictions.

Which was my point all along.

It doesn't even matter if people did use fake ID because we would still be following the same rules we are already following

Ugh nevermind

Oh, r18 v r21?

Doesn't bother me, I'm 22. Tongue

The only jurisdiction that matters is where the website is based.
You can't enforce your jurisdictions laws upon another.
