They cant give informed consent.

Children and the mentally ill/disabled cannot provide informed consent either.

Chimps have displayed an ability to understand what others are thinking. This is known as "theory of mind." This is something that human children do not display until around age 5. Chimps can therefore be empathetic. Chimps have displayed altruistic behavior. With appropriate language training, chimps have communicated with humans, sharing their wants/needs/desires.
