I think the answer to that is yes. ... but they might be required to demonstrate it.

So it seems to me that everyone's biggest gripe is that the baker wasn't operating as an exclusive club then. Kind of like he just reneged or something, and that's what everybody's pissed about?

Perhaps if he had just made it clear (and legal) that he was only operating a club, not a business open the general public, then everyone would've respected and accepted his decision? Consider

To be fair, he was kind of already operating like a club by excluding the gays. Only thing left to do would be to change the label and legal registering.

To be clear my reference is to the style of posting (cursing/name calling/swearing vs calm/polite/civil) not the subject matter. Though I suspect you also think more people agree with you than actually do.
