It was partially followed in regard to PoW's during the II WW when III Reich fought with western countries.

And love aside not everything is fair - shooting civilians for example - in war, though war itself isn't fair. Also it's winning side that decide which actions were fair. Not to mention that if nation is at war then perception of what is fair will change.
