Muslim-American says he will sue after finding tracking device
Washington (CNN) -- A young Muslim-American says he plans to sue the FBI and the U.S. Justice Department after finding a tracking device planted underneath his car.

Yasir Afifi, 20, accompanied by lawyers from the Council on American-Islamic Relations, told reporters at Wednesday that the lawsuit will seek compensation, an injunction, and a broader ruling against law enforcement's placing of tracking devices without a warrant. (Continues)

Nobody has ever put a tracking device on my car, or a bug to monitor me. Maybe I am not a dangerous enough person to warrant attention from a police agency. What is his problem?

I think it begins when media hyphenate his identity so that his faith takes precedent over his citizenship. And then it all goes to hell from there.

He's falling right into the trap, in any case. When he sues he'll have to challenge the Administrative branch of justice had no right to track his vehicle, which presents opportunity for the policing agencies to prove there was indeed probable cause based on his activities as an obvious person of interest.

I've never had occasion to think my vehicle/movements may be tracked by law enforcement. It's interesting that the same can't be said for Yasir Afifi in this case.

Well, per that article he didn't think so either. His mechanic found it while doing an oil change and he had to post pictures of it online to find out what it was.

Also, the FBI claiming they had probable cause for this is worthless unless they had a warrant.

I'm a bit sickened by the possibility they could have done this without proper due process, to be honest.

I've not committed to the research to support this observation however, I'd posit the USPA afforded jurisdictional protocols wherein a warrant wasn't necessary. Lovely little document that is. Took a double edged sword sharpened to it's finest and gutted the Constitution in less than 30 days from the moment it was inked until it was passed.

I really miss the gallows and the opportunity for toothy political activism to hold accountable Legislative necks that compromise a nations liberty and freedom. Cool

I ask as someone who is out of the loop - but as disgusting as this is , don't you have laws in the US that allow such actions ? Laws passed under Bush and never removed ?

I believe those you are recalling would be the aforementioned U.S Patriot Act. (Aka/ USPA)

Every citizen has the right to file a suit if he has threats to his life . He might sue against FBI if this is the fact otherwise he should not do because without proofs he can not sue against FBI . I hope that he might have the Proofs for it .
