NSA Watch
The Basic Facts:

The Second Circuit Court of Appeals passed a ruling this week declaring the NSA’s bulk collection of Phone Records illegal, insofar as the program has exceeded provisions set in place by the Patriot Act.

The American Civil /Liberties Union has supposedly lauded the decision, calling it “a resounding victory for the rule of law,” and a change to alter a legal landscape which has allowed the surveillance-industrial complex to indiscriminately stockpile information on millions of unwilling Americans.

Congress is currently in a debate over whether to renew the current rendition of Section 215 of the Patriot Act before its expiration date on June 1st . This would require them to sway the Supreme Court to reverse the Second Circuit’s decision. Otherwise, they may consider moving the USA Freedom Act forward, which would amend Section 215 restricting the Government’s access of phone records to those deemed “essential to investigation involving terrorism or espionage, thereby ending bulk collection while preserving the intelligence community’s power to gather focused information.”

The Freedom Act turns out to be very limited in its reach; it does not appear to address the NSA’s PRISM program which collects stored internet communications based on demands made to the nine major Silicon Valley Companies, nor does it deal with Section 702 of the Foreign Intelligence Surveillance Act, which permits the NSA to collect American’s international calls and emails without a warrant.

The bone of contention for attentive civil rights advocates and electronic privacy aficionados is that the Freedom Act does not go far enough in addressing the objectionable practices permitted under FISA and the Patriot Act. A clear indicator of the bill’s weakness, some claim, is that it appears to be facing little resistance from Washington bureaucrats and lobbying groups who, if something ostensibly or meaningfully limited the intelligence community’s collection powers, would raise hell.

What are your thoughts on the Second Circuit's decision? Would a passage of the Freedom Act be a step in the right direction, or is it simply lip service to keep privacy advocates docile while the NSA continues to wield a bloated stick?

Correct decision but shitty reasoning on the remedy.

Okay, I just found out the NSA named one of it's metadata programs "Skynet." Methinks they might be enjoying all the publicity they're getting.
