It is fascinating to see them straight out saying that they refuse to perform the duties that are part of the job they swore to execute. Any senator who says that they will reject any nominee out of hand should be thrown out of office. Obama has an obligation to nominate a new justice and the senate has an obligation to give that nominee a review.

The only mildly comforting part of this is that even if they manage to obstruct things for a year and they get a republican president it will leave the court in essentially the same state it has been. We'd possibly have a younger version of Scalia extending the negative influence for longer but at least it'd be no worse than it is now.

That is the problem. If the GOP gets the White House in 2016, they'll likely get to appoint two more Justices (one of them replacing Ruth Bader Ginsburg). If they get to pick Scalia's replacement, too, it would set the split to about 6-3, and it would stay that way for twenty years.

Looking at everything the House and Senate have been pushing, lately, I can see a whole new wave of voter disenfranchisement coming down, if this happens.
