Sex with drunk women
It is illegal to have sex without consent, including when an individual is unable to give consent due to unconsciousness or intoxication. However I propose a moral dilemma for your consideration:

A drunk woman tells a sober man she wants to have sex with him. She is obviously drunk (slurred speech, staggering etc.) but still conscious. The man has sex with her. Is this man guilty of rape? Is the woman responsible for her actions?

1. Would the woman be guilty of rape if she were sober and the man drunk?

2. If the woman drinks and drives she is held responsible for her actions, therefore is she not responsible for her actions when consenting to sex?

If she is conscious/aware enough to request sex then it is consensual, even if the person is wasted.

What bemore said...but the guy would be a dick for taking advantage of that situation. Reverse would be true for the switched situation.

This must come under the heading of 'legitimate rape'.

I suspect a few of us might have had that morning shock of waking up naked next to someone you don't recognise.

That mutual... "who are you?" moment.

Neither can remember consent and neither are sure whether any 'crime' was committed.

Obviously, 'yes' and 'no' are not always black and white... there are a number of shades of grey.

Have you forgot being a teen? You don't need to be turned on to get an erection. It may be rarer but women raping men can and does happen.

Yeah I used to get unwanted erections all the time. I can understand how a woman can force herself on a man and im not doubting it happens. I suppose what I meant specifically was penetrative sex. I dont see how a man can maintain an erection whilst put in that situation, even if they were spiked with Viagra or something.

This is one of the things that piss me off. I will tell you this much...

If you are both sober and have consensual sex she can file rape charges on you with mixed results.
If she is drunk and you are sober she can file rape charges on you.
If you are drunk and she is sober you can in theory file rape charges on her with mixed results. You will likely just be laughed at.
If you are both drunk and have sex she can file rape charges on you.

This isn't how it works on paper, but in reality this is how it works. Don't get me wrong, I'd still rather have a penis than a vag as we men still have way more advantages than women, but this one...not so much.
