Actually the notion that a document which emerged from the 18th Century Enlightenment, can or should somehow be the main reference document, to settle and address the complex issues including technology in a society that has moved on SO much since then, is completely STUPID.

Antonin Scalia did not agree with you. He said he only read the Federalist papers to discern the intent of the Founders, in order to settle cases.

Of course, that is part of a design that never intended to have most of "the laws in the U.S." be federal laws.

The intent was to create a system much more like the EU with a small and limited federal government and much more independent and sovereign member states.

Somehow we lost that system and began looking to the federal government to become the primary source of government rather than the states.

That's probably because it makes sense. We are no longer a 18th century agrarian economy who can largely ignore the world around us except in issues of trade. The need for individual states has really come and gone.
