Error #1
The 1st law of thermodynamics is about total energy of a closed system, not about availiable energy.
There is (total) energy in the universe, and there is energy availiable to get work done, "energy availiable".

Error #2
The fact that the universe will experience the "heat death" will be due to
1) space inceasing
but
2) availiable energy not increasing
Availiable Energy wont "run out", but its going to be dispersed infinitely.

Error#3
If dark energy is the -gravitational repulsive- vacuum energy of empty space, and this is currently our best scientific bet, then the universe is actually gaining total energy as it is gaining space (and its vacuum energy) and the 1st law of thermodynamics will have to be abandoned. The 1st law of thermodynamics is a scientific law and therefore subject to being questioned and being abandoned.
